Am I really affected by the obligation?

If your site or digital service is aimed at consumers and your company exceeds the micro-enterprise threshold (10 employees or €2M revenue), you are very likely affected. This covers e-commerce sites, online banking, booking platforms, audiovisual media, and any B2C digital service. The 28 June 2025 decree extended this obligation to the private sector, enforced by the DGCCRF. What are the concrete risks in a control?

The enforcement mechanism is progressive but designed to deter. The DGCCRF first issues a formal notice with a compliance deadline. If uncorrected, an administrative fine of €7,500 per violation is imposed — and it is cumulative: a site with 10 non-conformities could theoretically face €75,000. A daily penalty of €3,000 may be added until full compliance, capped at €300,000 total. Beyond the financial aspect, reputational risk is significant: enforcement decisions are published, and excluding users with disabilities represents direct customer loss.

Doesn't an automatic overlay or plugin solve the problem?

No, and this is critical. Automatic overlays only address 10–30% of accessibility criteria, and they do so superficially, without modifying the source code. French authorities, the Federation of the Blind, and the National Digital Council have all confirmed that an overlay does not constitute legal compliance. Only direct source-code fixes, documented by an RGAA 4 audit report from a qualified auditor, allow you to demonstrate compliance to regulators. Companies relying solely on an overlay face the same penalties as those that have done nothing — with the added risk of having invested in a false sense of security.

How long does compliance take?
